B. ALLOCATION PROPOSAL
GENERAL FUND ALLOCATIONS ARE TENTATIVE. THE AMOUNTS ALLOCATED MAY BE REDUCED BY EXECUTIVE RESTRICTIONS AND/OR INTERNAL REDUCTIONS.
ATTORNEY & RELATED FEES, 17746
1. Purpose
To provide funding for attorney and related costs that arise out of court judgments against the Department of Education (DOE) pursuant to the Individuals with Disabilities Education Act (IDEA) and Chapter 56. Federal and State laws, department rules and court orders require that the DOE provide equal opportunities to all disabled children, ages 3 to 20, regardless of the severity of their disability.
2. Rationale for Allocation
$700,000 in "B" funds is allocated to the Office of Curriculum, Instruction, and Student Support (OCISS), Special Education Section (SES) for attorney and related costs that arise from court judgments against the DOE pursuant to IDEA and Chapter 56.
3. Guidelines for Implementation
Funds are to be expended in accordance with the guidelines found in the "FMS User Policy & Process Flow Guide" and procurement law.
